1. Introduction
These Terms and Conditions ("Terms") govern your use of the Ultra Pool Care website (ultrapoolcare.com.my) and all swimming pool services provided by Ultra Pool Care, a division of Ultra Group ("we", "us", or "our"). By engaging our services or using our website, you agree to be bound by these Terms.
2. Services
Ultra Pool Care provides swimming pool cleaning, maintenance, repair, construction, design, and tile repair and regrouting services in Kuala Lumpur and Selangor. The specific scope of work, pricing, and timeline for each engagement will be communicated and agreed upon before commencement.
- All service quotations are valid for 30 days unless otherwise stated.
- Service scope is limited to what is specified in the quotation or service agreement.
- Additional work discovered during service delivery will be communicated to the client with a revised quotation before proceeding.
3. Booking and Scheduling
Services can be booked via WhatsApp, our website contact form, or by phone. Bookings are confirmed once we acknowledge your request and agree on a service date and time.
- We will make every effort to attend at the scheduled time, but delays may occur due to unforeseen circumstances.
- Access to your property and pool area must be provided at the agreed time.
- For recurring maintenance plans, schedules will be agreed upon at the start of the contract.
4. Payment Terms
- Payment terms and methods will be specified in the quotation or service agreement.
- For one-off services, payment is due upon completion unless otherwise agreed.
- For maintenance plans, payment is due monthly in advance or as specified in the contract.
- For construction and renovation projects, a deposit is required before work begins. Progress payments will follow the schedule outlined in the project agreement.
- Late payments may incur a late fee of 1.5% per month on the outstanding balance.
- All prices quoted are in Malaysian Ringgit (MYR) and are exclusive of SST unless stated otherwise.
5. Cancellation and Rescheduling
- One-off services may be cancelled or rescheduled with at least 24 hours' notice at no charge.
- Cancellations made with less than 24 hours' notice may incur a cancellation fee of up to 50% of the quoted service cost.
- Maintenance plan contracts require 30 days' written notice for cancellation.
- Construction projects are subject to the cancellation terms specified in the individual project agreement.
6. Warranty
We stand behind the quality of our work:
- Repair Services: A 30-day warranty on parts and labour from the date of service, covering defects in workmanship.
- Construction & Renovation: Warranty terms are specified in each project agreement, typically ranging from 6 to 12 months for structural and finishing work.
- Maintenance Services: Any issues arising from our maintenance work will be rectified at no additional cost if reported within 7 days of the service visit.
- Warranty does not cover damage caused by misuse, neglect, third-party interference, or natural disasters.
7. Liability
Ultra Pool Care carries appropriate insurance coverage for our operations. However:
- Our total liability for any claim shall not exceed the total amount paid by the client for the specific service giving rise to the claim.
- We are not liable for pre-existing conditions, damage caused by third parties, or issues arising from the client's failure to follow our recommendations.
- We are not liable for indirect, consequential, or incidental losses, including but not limited to loss of use or loss of profits.
- Clients are responsible for disclosing any known hazards, structural issues, or access restrictions before service delivery.
8. Client Responsibilities
- Provide safe and unobstructed access to the pool area for our technicians.
- Ensure all pets are secured during service visits.
- Inform us of any relevant property conditions, including electrical, plumbing, or structural issues.
- Follow maintenance recommendations provided by our technicians between service visits.
9. Intellectual Property
All content on our website, including text, images, logos, designs, and graphics, is the property of Ultra Pool Care or its licensors and is protected by Malaysian and international copyright laws. You may not reproduce, distribute, or use any content from our website without prior written consent.
10. Dispute Resolution
In the event of a dispute, both parties agree to attempt to resolve the matter amicably through direct negotiation. If a resolution cannot be reached, the dispute will be referred to mediation before any legal proceedings are initiated.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of Malaysia. Any legal proceedings arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
12. Changes to These Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services or website after changes are posted constitutes acceptance of the revised Terms.
